A-B seeks trademark protection in New Zealand - Anheuser-Busch - Brief Article

Associated Press-- U.S. beer giant Budweiser appealed to the New Zealnd High Court last week to prevent a brewer of traditional Czech Budweiser beer from using the name in New Zealand.

Anheuser-Busch, which brews Budweiser, claims Czech brewer Budejovicky Budvar is breaching local law by importing its own Budweiser brand when the U.S. company has the sole right to the trade name in New Zealand.

Despite an agreement by the Czechs that the Americans have the right to use the Budweiser trademark in New Zealand, a few bottles of the Czech beer have appeared in the country with the name on the label.

Anheuser-Busch, the world's biggest brewer, claims the Czech company has breached the Trade Marks Act and the Fair Trading Act by importing the beer into New Zealand.

A-B's lawyer Brendan Brown asked the court to revoke the Czech's New Zealand registered trademark of the Budejovicky Budvar name, saying they were not lawful. The packaging and labeling of the Czech bottles could mislead consumers, Brown said.
